The new appellate court case of People v. Colvin is good news for collectives. This case just came out and it affirms the right of collective operators to transport medical marijuana. Colvin was arrested after being pulled over transporting several pounds from one of his collectives to his second collective in Los Angeles County. While the Superior Court judge wrongfully convicted the man, the appellate court found that Colvin's transportation of the marijuana was covered under the Medical Marijuana Program Act and he should be acquitted.
Notably, the evidence showed that Colvin had 14 offsite grows and the Court did not find this to disqualify Colvin for the medical marijuana defense. This is great news for our collective operator clients. We will use this case in court to defend our clients next week. Ultimately, this case will have to be reconciled with City of Lake Forest v. Evergreen Holistic, which requires the dispensary to be at the grow, i.e. no offsite grows. Stay tuned.
